Has the Intellectual Property Right over ‘Arunachal Diary’ been infringed upon? (Updated)

I was going through the 29th August edition of ‘The Arunachal Times’ when I came across this report that took me by surprise. It read:

“The registering authority, Papum Pare district has registered two private news channels to be transmitted through the private cable TV channels in the Capital Complex under the provisions of the Cable TV Networks Regulation Act, 1995. The two registered news channels are “Aaz Ki Samachar” and “Arunachal Dairy”.”

It may be worth mentioning here that it was reported earlier that the ban on the ‘Aaj Ki Awaaz’ was lifted and it would be airing it’s programme from 1st of September, 2008 under the new banner of ‘Aaj Ki Samachar’. However, the district magistrate has denied lifting of ban on 'Aaj Ki Awaaz' and informed that the ban was still in force as two criminal cases are pending against the channel. Nonetheless, the District Magistrate has allowed Aaj Ki Awaaz's Executive Director to air another news programme under the banner of 'Aaj ki Samachar'.

Now coming back to the topic, has the Intellectual Property Right over Arunachal Diary been infringed upon? Well, the report made me feel that the Intellectual Property Right has been infringed upon by the private news channel and I'm exploring on that aspect both legal and otherwise.

What now?

May be I would write a letter to that private news network that they have probably infringed upon my Intellectual Property Rights and that they should consider re-registering their channel under different banner; as soon as I get their contact details.

Update 09-09-2008:

From the information I  received from Itanagar, it seems the private news channels banner is 'Arunachal Dairy' and not 'Arunachal Diary'. So, I guess no infringement of IPR issue...:)

Arunachal Epitome-States first eNewspaper

The huge hoarding that I saw earlier today, made me, literally rush to my computer and log onto the net. The advertisement was about launching of site Arunachal Epitome, which claimed to be updated hourly of the latest happenings of the state. Besides, it had a very interesting tagline "You See Today What Is Supposed To Happen Tomorrow.....", which reminded me of the media baron Elliot Carver and Carver Media Group Network of the 1997 James Bond movie- "Tomorrow Never Dies"(Good analogy, eh!....:)) Excited, I typed in their site address in the address bar only to be disappointed at what the browser displayed. See the snapshot below.



Contrary to what the advertisement claimed, the site was in construction stage without any news item so far even though it claimed to be 'the first eNewspaper from the state online since 2003'.

With only one online news site from the state - The Arunachal Times, I'm eagerly waiting for Arunachal Epitome to come out from it's construction phase and start uploading latest news updates from the state.

Yes, you heard it right, Arunachal Diary has switched from http://arunachaldiary.blogspot.com to it's own domain at http://www.arunachaldiary.com.

It took me a while to decide switching to own domain but nonetheless, it did finally...whew!

Ban on Aaj Ki Awaaz revoked

Quite a few months back, the local news programme 'Aaj Ki Awaaz', broadcasted over local cable television network at Itanagar was bannned by district administration for violating section 5, 6(d) and 6(e) of Cable Network Rules, 1994. Now, after little more than two months since the ban on the news programme was imposed, it has been revoked by the Papum Pare District Administration and the programme would be re-aired over local cable network from September, 1st under re-christened name of 'Aaj ki Samachar'.

The suspensionon 'Aaj ki Awaaz' a daily local news bulletin telecasted through the local cable network by the Papum Pare Deputy Commisioner has been revoked.

The DC had few months back suspended the broadcast of the news bulletin which telecast inappropriate news.

'Aaz ki Awaaz' has been renamed as 'Aaz ki Samachar' will start telecasting news from September 1 next.

Good for the denizens of Twin Capital Township of Naharlagun and Itanagar; now they will have access to the information around their neighborhood again. Hope the producer of the programme has become wise enough to ensure compliance of Cable Network Rules, 1994, under whose sections it was banned earlier to prevent another ban on the programme. :)

Arunachal introduces Rehabilitation and Resettlement Policy, 2008

As if to pacify the agitating anti-Dam activists in the state, the Chief Minister Dorjee Khandu announced framing of ‘Rehabilitation and Resettlement Policy, 2008’ during his independence day speech, which claims to be far more beneficial than that of the national policy. The salient features of the policy are (source Arunachal Front and The Arunachal Times):

  1. Ex-gratia grant of Rs. 50,000/- to each affected family rendered landless after acquisition and Rs. 40,000/- to each affected family who are left with land less than one hectare after acquisition.
  2. Allotment of agricultural land subject to a maximum of 1 Ha of irrigated land or 2 Ha of un-irrigated land subject to availability of government land in lieu of affected agricultural land and remaining cultivable land will be compensated @ Rs. 1.75 lakhs/Ha.
  3. Community shall be compensated @ Rs. 1.56 Lakhs/Ha for loss of customary rights and privileges of tribal people to collect and use forest produce (traditional land use) from unclassed state forests (USF) and @ Rs 0.78 Lakhs/Ha from Reserved Forest Land. In addition to this, the community will be paid a sum equivalent to 25 percent of Net Present Value (NPV) of the USF, as decided by the government of India from time to time, in case of diversion of USF as compensation towards extinction of their traditional rights over USF land use.
  4. A plot of 250 m2 of land in rural areas or 150 m2 of land in urban areas and a free of cost house or one time financial assistance of Rs. 2.50 Lakhs for construction of house to affected family.
  5. Basic amenities like safe drinking water supply, drinking water for cattle, one toilet each per 3 affected families, rain water harvesting device, sewage treatment plant including drainage system, domestic lighting, shopping complex including fair price shops, public health centers, community center, school complex with playground, children’s playground, burial/cremation ground, roads etc. shall be provided in the resettlement site for affected families in the event of involuntary displacement.
  6. Rs. 1.00 Lakh (minimum) one time livelihood or rehabilitation grant per affected family.
  7. Financial assistance of Rs. 20,000/- as a transportation grant to displaced family for transportation of their household goods, cattle etc., to resettlement site.
  8. One time financial assistance of Rs. 25,000/- to displaced rural artisan, small trader or self-employed person for re-setting up of their shops in the resettlement site.
  9. Scholarship and other skill development opportunities to eligible person/s of the affected family.
  10. Free 100 units of electricity per month for 10 years from the date of commissioning of Hydro-Electric Project.
  11. 25 % job reservation in managerial/professional post, 50% job reservation in ministerial/clerical post and 25% and 75% job reservation in skilled and unskilled categories respectively in the Hydroelectric Project implementing companies for local tribal people; subject to candidates fulfilling the job requirement.
  12. Pension of Rs. 500/- per month for life to vulnerable affected person such as widows, unmarried adult women, all those above 50 years of age without family support.
The framing of RRP-08 is an welcome move by the government for the affected families of mega projects, though it has come all too late after the state government has rampantly signed MoA with various Hydro-power Developers-both Private and PSU's to execute 53 hydroelectric power projects with a total installed capacity of 26,000 MW (Source: Arunachal Front). Considering the fact that rehabilitation and resettlement is an inevitable part of any mega projects, the government should have come up with his policy earlier; when it knew since two decades back that the state had immense hydro-power potential and that one day or the other it has to be tapped.

Now, it has made me wonder, why was it formulated now? Was it formulated to pacify the anti-dam agitators as I expressed in the preceding paras? Or was it to show that 'people's interest' comes first while formulating any development activities as was put forward by CM during his Independence Day Speech.

"Since "People First" is the watchword of my government we cannot jeopardize the life of the people and their means of livelihood by building dams. If affected people do not want dams in their area, we will not have it. But the affected people should not allow themselves to be dictated by outsiders in the name of misplaced environmentalist", the Chief Minister said in his speech.

But then, why this policy was not thought of prior to rampantly signing of MoA's with various Hydro power developers? Will it be ethical on the part of government to scrap the MoA signed in the event of affected people not wanting dam in their area as put forward by CM? What about sanctity of the Contract? Was it the case of short-sightedness on the part of the government?

Now, it would be interesting to watch how the government plans to introduce this policy in the MoA's already signed without diluting the sanctity of MoA.

Cartoon-oscope #1

In continuation to my earlier cartoon series (1, 2, 3) where I tried to address the issues through the protagonists, I would now try to do cartoons on present state of affairs not restricting myself using only the protagonists, in a series called Cartoon-oscope beginning with the cartoon above. However, the protagonists too would continue to appear off and on in this series.

Woes of Monica Devi-A 'Question Mark' to Indian Sports

Despite the series of doping scandals hitting the Indian Weightlifters, when Laishram Monica Devi, a lifter from Manipur confronted the Executive Director (Teams) of SAI, R.K. Naidu and demanded her test result to be shown which says she has flunked the dope test and when she said, “Forget life ban, give me public execution if I am dope cheat”, at a press conference, I thought there may be some truth in what she says and that there may be something fishy about the dope test result that was disclosed just hours before she was to board her flight to Beijing to take part in the Olympics.

Back home at Manipur too, the report of positive dope result and the timing of declaration of result, didn’t go down well with the sportsperson and the people; with MOA (Manipur Olympic Association) deciding not to send participants to any National Championship and forthcoming National Games if Monica Devi is not sent to Beijing and citizens calling general strike on 8th August to protest dropping of Monica Devi at the eleventh hour.

Substantiating the general speculation that there may be something fishy about the dope test result, Monica Devi was cleared of all the charges. But alas, it came all too late for her to join the contingent to Beijing Olympics. India’s Olympic contingent Head Baljit Singh Sethi has said that there is no way Devi can compete. The entries closed on Aug. 7 for her event.

All this drama of doping charge at the eleventh hour and clearing of charges later, denying chance to sportsperson of this region to represent the country has put a big ‘Question Mark’ to the future of aspiring sportsperson of the region and the sports in India. Why this 'politics' to sabotage a sportsperson career and a chance to Olympics? Was it the case of preference over performance? Or as a colleague of mine suggested, it was a familiar case of intolerance of so-called mainstream Indian to the North-Easterner, which on any other time I would have differed but for the circumstances and timing of clearing the charges, which was in his favor.

Now, it would be interesting to see what action would be initiated against those responsible authorities. Or would there be any action at all?

Arunachal Diary turns two

Yes..Arunachal Diary has sailed through yet another year and has turned two. In fact, it turned two yesterday and has entered into its 3rd year in blogosphere. Thank you all for keeping me going. Without your comments, brickbats and appreciation, I would have long since ceased to update the blog, but for you guys.


And to show my appreciation, I’m handing out an Anniversary Issue of Arunachal Diary in the form of e-book or rather e-magazine for free (see pic on left)….but you have to wait for a while, may be till the last week of the month to get hold of this e-magazine...it's in the final stage of writing:).

What you can expect from this e-mag?

Collection of articles published in Arunachal Diary over these past two years some edited and some unedited including photo features and cartoons...which I feel would be a collectors item for the fans of Arunachal Diary.

Looking ahead, I'm planning introducing some changes in Arunachal Diary but that would take a back seat for a while till the broadband and dial-up connectivity out here is up and running smoothly. The broadband connectivity is expected to be restored by 15th of August, as promised by BSNL authorities.

Till then, do bear with the low frequency of posting.

And thank you once again guys for letting Arunachal Diary sail through another year.

Radio Oo La La 91.9 FM launched at Itanagar

Gone are the days when we used to tune into Radio if we had to listen to music. Boy..who would forget the mesmerizing voice of Ameen Sayani over Radio Ceylon and later Vividh Bharti of AIR. But with time, the media for listening to music changed. Transistor sets- as Radio was known at that time, was replaced by Tape Recorders and more recently by CD and DVD Players and yepp not to forget the tiny..portable..media players. Now people had more choice to listen to their kind of music than to listen to selected music aired over government airwaves and listeners to radio declined.

With the advent of FM channels operated by private players, radio has gained popularity once again with percentage of radio listeners increasing from 20% to 75% in cities like Kolkata (Radio-Track 2003 Survey). However, Arunachal Pradesh has yet to see the increase in radio listeners as witnessed in other parts of the country as FM Channels by private players had yet to make foray into Arunachal Pradesh.

But now, it seems things would change, for a private FM channel Radio Oo La La, 91.9 FM has made foray into the state after it has set it's station at Guwahati, Shillong and Agartala. It's station at Itanagar was launched yesterday.

Watching the inaugural function aired over NETV and watching the RJ's of Itanagar Radio Oo La La 91.9 FM introducing themselves, it seems people of Itanagar is going to be swept away by them and it would be fun listening to the Radio again.

Radio Oo La La 91.9 FM launched at Itanagar

Gone are the days when we used to tune into Radio if we had to listen to music. Boy..who would forget the mesmerizing voice of Ameen Sayani over Radio Ceylon and later Vividh Bharti of AIR. But with time, the media for listening to music changed. Transistor sets- as Radio was known at that time, was replaced by Tape Recorders and more recently by CD and DVD Players and yepp not to forget the tiny..portable..media players. Now people had more choice to listen to their kind of music than to listen to selected music aired over government airwaves and listeners to radio declined.

With the advent of FM channels operated by private players, radio has gained popularity once again with percentage of radio listeners increasing from 20% to 75% in cities like Kolkata (Radio-Track 2003 Survey). However, Arunachal Pradesh has yet to see the increase in radio listeners as witnessed in other parts of the country as FM Channels by private players had yet to make foray into Arunachal Pradesh.

But now, it seems things would change, for a private FM channel Radio Oo La La, 91.9 FM has made foray into the state after it has set it's station at Guwahati, Shillong and Agartala. It's station at Itanagar was launched yesterday.

Watching the inaugural function aired over NETV and watching the RJ's of Itanagar Radio Oo La La 91.9 FM introducing themselves, it seems people of Itanagar is going to be swept away by them and it would be fun listening to the Radio again.

HYPOCRISY AND CHINA-BASHING

We saw many men and women jumping on the bandwagon of anti-china campaign. Amongst the campaigner was the ex-Presidential candidate Hillary Clinton who appealed George Bush to boycott the opening ceremony of Olympic because she is concern about human rights in China as if the human rights are not violated in USA. Shall we forget about the detainee in Guantanamo Bay prison? Shall we forget the invasion of Iraq and the photographic images of prisoner in Abu Ghraib prison? Killing of more than 1.2 million non-combatant Iraqis in the last five years is perhaps insignificant because the killing is taking place in Iraq, not in the land of American, British or Canadian.

Barrack Hussein Obama and John Sidney McCain also joined in a chorus of boos. And it was expected. They had to because the pull of Oval Office demands so. Let’s see if warmonger and Vietnam War veteran John McCain will be able to secure the president chair. I wish he fails as his presence in the white house will remind many to the era of “Baby Killer”, “Napalm Bomb” and “Agent Orange”. Hope that Hollywood star Mia Farrow and Steven Spielberg would now say something about the oppression and mal-treatment of native/marginal ethnic community in US.

On February 28, 2002 in Gujarat Muslims were massacred mercilessly and Bharatiya Janata Party (BJP) justified the genocide citing Newton’s law of action-reaction. In 2008, BJP is coming out in support of ‘Free Tibet’. They even want to show solidarity with the Spiritual leader of Tibet and the separatist cause. Wow! It indeed sounds great. Or was it just another case of double standard?

Chancellor Angela Merkel of Germany, British Prime Minister Gordon Brown, and President Nicholas Sarkozy of France, Archbishop Desmond Tutu and U.N. Secretary-General Ban Ki-moon have also expressed their intention – not to attend the Olympic. Do they want to turn the Olympic Games into a political arena? As far as I know, French thinker and educator Pierre de Coubertin made the proposition to revive Olympic Games of ancient Greece to promote WORLD PEACE. But in quest of global hegemony and under finger-pointing situation, world peace looks rather unattainable. On the contrary, resurgence of cold war seems more real. After the disintegration of USSR in 1991, it appears that the China being a communist country becomes an obvious target.

All this is not to say that China is unblemished. In fact, the insincerities of Chinese government come to the fore whenever they show their resentment with Japanese officials who pay a visit to the controversial Yasukuni shrine, which is associated with extreme militarism and dedicated to Japan’s war dead whereas they had already exhibited the extreme militarism in Tianenmen Square Protest, where People’s Liberation Army brutally crushed pro-democracy supporters and killed hundreds of their own compatriot. Then there were Tibetan rebels in 1959 Tibetan uprising. In 1980, China had admitted that Tibet has been misgoverned. It’s pointless to say that Tibet has been misgoverned when the Tibetans don’t want to be governed by them.


HYPOCRISY CONTINUES…

Kosovo parliament on 17 February 2008 declared independence from Serbia. And Germany became the first country to recognize Kosovo as sovereign state by renaming its diplomatic office as an embassy. The US, UK, France along with 19 out of 27 European Union states has formally recognized the republic of Kosovo. Why only Kosovo, Tibet and Israel should be supported by west. Why is that separatists like Tamil Eelam, Chechnya, Kashmir and Nagaland do not get equal attention as their counterparts. They too have the right of self-determination. Is it because these separatists would not take part in a puppet play and doesn’t fit in the game plan?


ISRAEL – PALESTINIAN IMBROGLIO

Before the introduction of cable TV, we only read and heard about Israel-Palestinian conflict. Now the bloodbath is taking place right in our drawing room. We see Israeli missiles being thrown at Palestinian. We saw journalist and civilian being killed by it. We see rubble and ruins, destitute and sufferer.

And so much blood and bitter tears had been shed in the Israeli-Palestinian conflict. Yet there’s no moment of respite. Solution to this maelstrom of skirmishes seems far from imminent considering that both Israeli and Palestinian is hooked in the chicken-and-egg dilemma. Israeli wouldn’t give up the occupied territories because of terrorism and the Palestinian in order to regain their territory would not stop suicide attacks.

One wonder doesn’t the condition of Gaza remind the Israelites of Ghetto or concentration camp and lebensraum concept of Hitler? In the eye of onlooker, it is virtually as similar as holocaust or in Jewish terms – shoah. Palestinian seems to exist in the same condition as Jews in ghettos during Nazi time – appalling living condition, frustration, desolation, hopelessness. If Israelites have any respect for their forefather who perished in the holocaust, they ought to think of a fresh peace talk, which should be based on honest peace process and, more importantly, honoring the peace accord.

As to international peace brokers in the Middle East peace process, they truly need to work as an unadulterated mediator – disallowing bias views and extreme lobbying. If not, we just have to say: Long live Nazism! Long live genocide!


ALL THAT GLITTER IS GOLD

It is absolutely not necessary that one must drink Pepsi and Coca Cola because people will not die if they don’t drink this stuff. A person could manage with plain water. PepsiCo and Coca Cola Co. have often hit the headlines in India for exhausting ground water, which is required for irrigation. Moreover, land swallowed by this kind of redundant industries can be used for growing crops to feed millions and millions of people. We need solid food – not carbonated water – to survive. Turning the farmland into fuel land as in the USA and elsewhere, and Special Economic Zones (SEZs) in India, China, South East Asia and Middle East, I dare say, has made a great impact on food crisis. And we recently saw the consequent of it when the people in Bolivia, Cameroon, Egypt, Indonesia, Senegal and Uzbekistan had went on the rampage to protest against the scarcity of food and rising food prices.

Again, we don’t need any cheap car like Tata Nano. We could manage with public transport. And it is just that we are being brainwashed and pushed by corporate, and allowed them to inculcate in our mind that we really are desperate for cheap car. Or am I wrong in thinking that food have precedence over luxurious items. Besides, who is going to peer inside your stomach if it is full or empty? It is façade that matter most to the people. Thus, we have a flashy cars and a wanton war to procure oil to keep those flashy cars on the run.


GLOBAL’S CAPITAL

Twenty-five years ago, when I was a kid I used to put out a mug filled with water or milk or black tea at night on the byaggo or uko sembya (unroofed porch) like all other kids at Ziro. And, in the morning, we would find our mug froze from top to bottom. So without the help of refrigerating technology we could make ice creams. And we certainly did take pleasure in those indigenous ice creams. But it’s all gone now. Three inches
thick ice has turned into wafer thin. And the summer is getting unbearable. So we do not need any scientists to tell us that the global warming is not real.

Civil Society Coalition on Climate Change (CSCCC) reports (available at http://www.csccc.info) – which seems to me more like a report on what the rich can do and the poor cannot, rather than climate change – suggests oneself to adapt with climate change instead of doing something to reduce the agent that cause global warming. What else can we do than adapt if the hypocrite is not ready to give up their hypocrite lifestyle? And while going through this report it occurs to me that those collective geniuses at CSCCC almost exhaust the word ‘insurance’ that reminds me and reintroduce me to the year 1997-98 when a large number of bigoted people of Arunachal were struck by fear psychosis because an obsessive scientist from Assam predicted a massive destructive earthquake in Arunachal. I doubted a nexus between that obsessive scientist and insurance company. There never was any investigation. It is an ironic that people believed such whimsical prediction while everyone shelves the topic of global warming.

Furthermore, CSCCC wrote so much about wealth in their report that makes the report virtually farce and unreliable. Believe it or not, according to CSCCC report, the wealth is a cure for all ailments. There’s no doubt; nearly half of the world population or more than that will vindicate that Money makes the world go round.

If money is that much important, then let’s make money. That’s not a big deal. Eh? First, we have to forget about the “GHGs” and “Asian Brown Haze”. Athletes who seem to be concern about their health in a polluted environment, let’s say Beijing, need to adapt with high level pollution of land, air and water. More importantly, the restriction imposed on Arunachal for doing indiscriminate timber business has to be revoked as Arunachal has an abundant supply of Burmese teak and pinewood. After all, it brings in a lot of money. Besides, legions of people who went solvent after the ban may once again become a filthy rich. And when enough money will be made, we can have caviar everyday. And when the sturgeon fish will extinct, we could always devour each other. We seem to be very proficient at that.


THE MORE, THE MERRIER

Very few journals are capable of catching my attention and one such is OUTLOOK magazine. In mid-June 2008, they brought out an issue with special reference to environment. Honestly, it was excellent. But I couldn’t help myself marveling at consideration that outlook group have already six titles in their control and, of late, they had launched one more journal. Hmm… how many trees would that be? Perhaps, this is what we call onslaught on consumer by media.
