Vote-not-to vote: The lesser known voting rule; Rule 49-O

One of the reader of Arunachal Diary asked me if I could throw some light on Vote-not-to vote rule or rather Negative/Neutral vote or 'Nota' (None of the above). As it would have been a long reply almost sufficing a single post, I thought of doing a post on itself.

Post 26/11 Mumbai terror attack, one lesser known rule of 'The Conduct of Elections Rules, 1961', has been doing round in blogosphere and social networking sites and has been a subject of debate. It is the Rule 49-O of 'The Conduct of Election Rules, 1961'-the rule, which as a matter of fact I too was quite unaware of. It was triggered by hoax email that was doing round the web, apparently since past couple of years but which gained momentum post 26/11 Mumbai terror attack.

So what is Rule 49-O of The Conduct of Elections Rules, 1961?

It says that if elector decides not to record his vote, then the elector may do so by notifying the presiding officer and putting signature or thumb impression in Form 17A which exposes the identity of the elector and making them vulnerable to threat and intimidation. It also defeats the purpose of 'secret ballot'.
49-O. Elector deciding not to vote.-If an elector, after his electoral roll number has been duly entered in the register of voters in Form-17A and has put his signature or thumb impression thereon as required under sub-rule (1) of rule 49L, decided not to record his vote, a remark to this effect shall be made against the said entry in Form 17A by the presiding officer and the signature or thumb impression of the elector shall be obtained against such remark.

What is so special about this rule that it became a buzzword and a subject of debate in the web?

The hoax email that did round the web, apparently seems to state that 'if the number of people who invoke the right to 49-O is more than the winning candidates vote count, a re-poll is ordered with something amounting to a permanent ban on the previous candidature'. Having disillusioned with the voting system of the country to elect their representative whereby there was no option other than to choose the candidate which was less unappealing than the others; this gave some sense of power to elector to accept or not-to- accept or to reject the candidates altogether by putting 'Negative/Neutral' Vote. It was felt and hoped that by exercising this option, the wronged system can atleast be corrected. And ever since, people have been debating about the viability of this option.

Can a re-poll be ordered by invoking Rule 49-O?

No, with the present Rule 49-O, there is no option that a re-poll could be ordered if the vote count invoking Rule 49-O is greater than the vote count of winning candidates. In other words, it would be much similar to abstaining from exercising your franchise or to make your vote invalid. 49-o.info has succinct information on Rule 49-O. So, not until the rule is amended based on EC recommendations and a clause inserted for re-poll and disqualification of candidature, it would be futile and 'waste' of vote to invoke 'Rule 49-O' except to compromise your identity and expose you to the vulnerability of being intimidated.

Little did I thought that the news of discovery of wreckage of WWII B-24 aircraft somewhere in Arunachal Pradesh that appeared in the local dailies of the state quite sometimes back, could be of any importance (I just didn't paid much heed to that news item that time and guess those of you who had come across this news in the local dailies did the same too), until I received this mail from Gary Zaetz (reproduced below).

I am an American from Cary, North Carolina. For many years, I had known that my uncle, U.S. Army Air Force 1st Lt. Irwin "Zipper" Zaetz, had disappeared along with his entire crew on January 25, 1944 when his B-24 Liberator aircraft "Hot as Hell" failed to arrive at its destination of Chabua, Assam on a flight over the "Hump" from Kunming, China. Then, this past summer, I was surprised to learn while surfing the Internet that an American investigator, Mr. Clayton Kuhles, had discovered this aircraft while searching for aircraft wrecks in Arunachal Pradesh in December 2006. According to the report he filed with the US Government, the wreckage was found in the mountains of the district of East Siang. Since learning this news, my father and wife and I have spent every spare moment searching for relatives of the other crewmen, and working with the US Government to arrange the sending of a recovery team to the site of the crash, where human remains are reported to have been found. We are hoping that the Government of India, the Government of the State of Arunachal Pradesh, and the US Government will cooperate, in the spirit of humanitarianism, to recover the bodies of our loved ones and return them to us. If you are interested in more information on this, or would be willing to assist us in this effort, please email me at garyngina@earthlink.net. Thank you for this opportunity to get the word out about this matter of great importance to eight families.
I request all my readers from East Siang District and Arunachal Pradesh as a whole to come forward and help locate the mortal remains of all the 8 crew members of that ill-fated B-24 aircraft, so that they may be given a 'permanent resting place'. Any information related to the wreckage of B-24 or of the mortal remains of the crew members may be mailed at garyngina@earthlink.net or at arunachaldiary[at]gmail.com.

Arunachal Diary Sports a New Look (Updated)

For quite sometimes, I was thinking of enhancing the appearance of the blog and to include a navigation link tab. So, I decided to experiment with the CSS and here you are with a brand new look for Arunachal Diary. There are some issues to be resolved, though.

  1. Presently, the 'About' navigation link has not been linked to about page-which I would be doing soon. Done.
  2. Something is wrong with the 'Recent Comments widget'-got to debug. Resolved using hack by Ramani.
  3. 'Read More…' option is showing at all the posts. Resolved using hack by Ramani.
Hope I'm able to resolve the above issues soon.

Do put in your comments on how you find the new look.

Poll Results-Dree Football Tournament

When I started this poll-"Which team do you feel would steal away the Dree Football 2007 Trophy?", I didn't expected that 183 votes would be polled. Since, today is the finals of the game I'm summing up the poll results. Out of 183 votes polled 75% voter feels that Hari Sports Club would be the ultimate winner, followed by Sojang Lapang Sports Club at 16%, followed by Diibo Sports Club at 7%. AHSA and 1948 Sports Club got 1% vote each.

Should the Student Unions restrict themselves to activities pertaining to Students welfare only?

Well here is what the reader of this blog feels. Out of total 10 votes, very miniscule to arrive at any conclusion, right, but anyways, 80% of the reader feels that the Students Union should restrict themselves to student's welfare activities alone, 10% says no and yet another 10% is unsure about what the Students Union should do.

On Comments

Off late I’ve been unable to reply to the comments that have been posted on the blog. It doesn’t mean that I don’t go through the comments or I don’t want people commenting on my post (in that case I wouldn’t have comments enabled on my posts, would I?) But with slow net connection (dial-up service provided by BSNL), I have to choose one option-either of posting on the blog or replying to the comments. And in most of the cases I chose former, simply because I want to keep my blog updated. Since, I do consider blog as a platform to exchange views about anything and have a healthy debate on the issues, I would appreciate people continue commenting on my posts. And despite the slow net connection, I would try to do both, i.e., keep posting and replying to comments. So do keep commenting.
